In Kolchugino, the Court Acquitted a Man Who Allegedly Drove Drunk

On the day of his "detention," the plaintiff was on a business trip in another area

A non-typical situation was considered in the Kolchuginsky District Court. The plaintiff asked to restore the deadline for appealing his administrative responsibility. S.A. Kalashnikov was allegedly stopped on February 27 by the local officers of the State Inspectorate of the Ministry of Internal Affairs, believing that he was drunk behind the wheel. At that time the man refused to have a medical examination for alcohol.

Such action shall entail the imposition of an administrative fine in the amount of 30 thousand rubles with deprivation of the right to drive vehicles for a period of one and a half to two years.

Kalashnikov himself did not know about his detention. As it was found out during the session, the man was on business trip outside Vladimir region since February, 14 till March, 1, 2022.

The traffic police inspector invited to the court also did not recognize in Kalashnikov the man he detained on February 27.

“Visual comparison of the person who participated in the trial and the person depicted on the copy of the driving license and on the video recording of February 27, 2022 presented by the OGIBDD allowed to conclude that the video recording recorded not Kalashnikov S.A., he was not involved in the event of the administrative offence in question”, – reported on the website of the court.

Failure to notify of the proceedings initiated against the plaintiff was recognized as a valid reason for missing the deadline for appeal.

The Kolchugin City Court decision restored the period of appeal, the decision was cancelled, the proceedings were terminated.
